What personal information do we process? When you visit, use, or navigate our Services, we may process personal information depending on how you interact with us and the Services, the choices you make, and the products and features you use. This includes content you create and share on the Services, such as videos, images, and comments.

Do we process any sensitive personal information? We do not collect sensitive personal information for its own sake. However, content you choose to upload may contain images of you or others, and we process all uploaded content solely for content moderation, safety, and legal compliance purposes, as described in Sections 2 and 3.

How do we process your information? We process your information to provide, improve, and administer our Services, communicate with you, for security, safety, and fraud prevention - including screening user-generated content - and to comply with law.

Do we broadcast your activity to other users? Yes, if you are 18 or over. While you are on the home feed, the content you are viewing (with its audio) and a live chat are broadcast in real time and visible to other users by default - see Sections 1 and 3 for details. This feature is not available to users under 18, and the viewing activity of users under 18 is not broadcast.

How do we keep your information safe? We have adequate organizational and technical processes and procedures in place to protect your personal information. However, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure.

1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

The personal information we collect may include: names, phone numbers, email addresses, usernames, passwords, contact preferences, contact or authentication data, date of birth, and user profile image.

User-generated content. We collect the content you create, upload, or share on the Services, including videos, images, audio, captions, comments, messages, and profile information. This content may include your image, voice, or likeness, or those of other people who appear in it. User-generated content you publish may be viewable by other users of the Services.

Live content. Studios are available only to users aged 18 and over. If you are 18 or over, then while you are on the home feed of the Services, we automatically broadcast the video content you are viewing, together with its audio, in real time to other users of the Services, along with a live chat feature other users may use to comment in real time (a "Studio"). This broadcast is on by default whenever you are on the home feed; when you navigate to another part of the Services, it continues for approximately 25 seconds before stopping automatically. It does not include your device's camera or microphone unless you separately choose to activate them. Your Studio and its live chat are visible to other users of the Services generally, not only to your followers. If you are under 18, no Studio is created for your account, your viewing activity is not broadcast, and you cannot view or join a Studio hosted by any other user. We process live video, audio, and chat content in real time in order to operate the feature. We do not, as a general matter, record or retain the audio or video content of Studios. Where we receive a report of a potential violation of law or of our Terms of Service during a Studio (including content involving the exploitation of minors), we may capture and retain the relevant portion of the session and associated account information, as described in Section 6. Other users viewing your Studio may also use the Services' capture feature to save a short clip of your Studio to their own device, in the same manner as a screenshot; we are not notified when this occurs and do not control what a user does with a clip after saving it.

Sensitive Information. We do not request or intentionally collect sensitive personal information such as health data, precise biometric identifiers used to identify you, or information about your racial or ethnic origin. However, content you voluntarily upload may reveal such information, and all uploaded content is subject to the automated safety analysis described in Section 2. This analysis is performed solely for content moderation, safety of minors, and legal compliance, and is not used to identify individuals or for advertising.

Third-Party Login Data. You may register and log in using your Google or Apple account, or by creating an account directly with your email address and password. If you use Google or Apple to log in, we receive certain profile information from that provider (such as your name and email address) as permitted by your settings with that provider.

SMS Verification. If you provide a phone number, we may send you a one-time passcode by text message (SMS) to verify your identity or your phone number, such as during account registration or sign-in. By providing your phone number for this purpose, you consent to receive these verification messages. Message and data rates may apply. These verification messages are separate from any marketing communications, and we do not use your phone number to send marketing messages without your separate consent.

Application Data. If you use our application(s), we also may collect:

We automatically collect certain information when you visit, use, or navigate the Services. This includes log and usage data, device data, and location data. This information does not reveal your specific identity but may include device and usage information such as your IP address, browser and device characteristics, and operating system.

Our use of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

3. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

Other users of the Services. As described in Section 1, if you are 18 or over, while you are on the home feed the video content you are viewing (with its audio) and an associated live chat are broadcast in real time and visible to other users of the Services by default. This broadcast continues for approximately 25 seconds after you navigate away from the home feed before stopping automatically. Other users may also capture and save a short clip of your Studio to their own device, as described in Section 1. Studios are not available to users under 18, and the viewing activity of users under 18 is not broadcast.

We may share your data with third-party vendors, service providers, contractors, or agents who perform services for us. Categories of third parties include:

Legal obligations and safety. We may preserve, access, and disclose your personal information - including your content, account information, IP addresses, and usage records - to law enforcement, governmental authorities, or other third parties where we believe in good faith that doing so is required by law (including reporting apparent child sexual abuse material to NCMEC under 18 U.S.C. ยง 2258A), necessary to respond to legal process, or necessary to protect the rights, property, or safety of our users, the public, or our company.

We may also share your personal information in connection with a merger, sale of company assets, financing, or acquisition of all or a portion of our business.

4. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

We may use cookies and similar tracking technologies to gather information when you interact with our Services.

5. HOW DO WE HANDLE YOUR THIRD-PARTY LOGINS?

Our Services offer you the ability to register and log in using your Google or Apple account. We will receive certain profile information about you from that provider (such as your name and email address), and will use it only for the purposes described in this Privacy Notice.

6. HOW LONG DO WE KEEP YOUR INFORMATION?

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, or for the period of time in which users have an account with us. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it.

Notwithstanding the foregoing, we may retain specific content and associated account information for longer periods where required to comply with legal obligations - including preservation obligations related to reports made to NCMEC or requests from law enforcement - or to enforce our Terms of Service, resolve disputes, and maintain records of moderation actions and account terminations (for example, to prevent banned users from re-registering).

Studios. We do not retain the audio or video content of Studios as a general matter. Where a portion of a Studio is captured due to a flagged violation or report, it is retained only for as long as necessary for moderation, legal compliance, and safety purposes described above.

7. HOW DO WE KEEP YOUR INFORMATION SAFE?

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. Content preserved for legal compliance purposes is stored with restricted access. However, no electronic transmission over the Internet can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers or other unauthorized third parties will not be able to defeat our security.

8. WHAT ARE YOUR PRIVACY RIGHTS?

You may review, change, or terminate your account at any time. To do so, log in to your account settings and update your user account. If you have questions or comments about your privacy rights, you may email us at support@it-hit.com.

If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time by contacting us using the contact details provided in this notice. Please note that withdrawal of consent or deletion of your account does not affect processing or retention that is required by law, including content preservation and reporting obligations described in this Privacy Notice.

9. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems include a Do-Not-Track ("DNT") feature. We do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. California law requires us to let you know how we respond to web browser DNT signals - at this time, we do not respond to them.

10. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to, correct, or delete the personal information we maintain about you.

Your rights may include: right to know, right to access, right to correct, right to request deletion, right to obtain a copy, right to non-discrimination, and right to opt out of targeted advertising or sale of personal data.

To exercise these rights, you can submit a data subject access request or email us at support@it-hit.com. Certain information may be exempt from deletion requests where retention is required by law, including preservation obligations described in Sections 3 and 6.

If your appeal is denied, you may submit a complaint to your state attorney general.

We may update this Privacy Notice from time to time. The updated version will be indicated by an updated "Revised" date at the top of this Privacy Notice. We encourage you to review this Privacy Notice frequently.
